By reserving a yacht or utilizing our Service, you consent to these Terms. If you do not agree with any section of these terms, you are prohibited from using the Service.

2. Service Overview

CommonsAnchorPoint offers a range of premium yacht chartering services that include, but are not limited to:

  • Day hires of yachts
  • Evening sails
  • Business getaways
  • Exclusive gatherings
  • Extended voyages

All offerings are contingent on availability and climatic conditions. We maintain the discretion to adapt or discontinue services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When you wish to make a reservation for a charter, you are required to:

  • Be of at least 18 years of age
  • Ensure all provided details are precise and complete
  • Remit the stipulated advance payment specified in the reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only after the payment is processed and we provide written affirmation. We reserve the authority to deny service to anyone as per our judgement.

3.3 Availability

The accessibility of charters is dependent on the availability of vessels and favorable weather conditions. We will endeavor to accommodate your desired booking times and dates as feasibly as possible.

4. Payment Terms

4.1 Pricing

Quoted prices are in € and incorporate all pertinent taxes, unless stated otherwise. Prices are liable to change with no prior announcement.

4.2 Payment Schedule

  • Deposit: 50% of the overall cost of charter due upon reservation
  • Final Payment: Payable 48 hours prior to the departure of the charter
  • Additional expenses (if any): Payable after the completion of the charter

4.3 Payment Methods

We accept major credit cards, electronic bank transfers, and bank-certified cheques. All payment processing is conducted through encrypted and secure systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Complete refund minus processing costs
  • 24-72 hours before departure: Refund of 50%
  • Less than 24 hours before departure: No refund provided

5.2 Weather Cancellations

If our captain determines the weather conditions unsafe, we will propose:

  • Rescheduling your charter at no extra cost for the earliest convenient date
  • Issuing a full refund if rescheduling is unfeasible

5.3 Mechanical Issues

In the unforeseen event of mechanical failure with the designated vessel, we will try to arrange an alternative. Should no substitute be available, a complete refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

Passengers are required to:

  • Adhere to all directions from the crew
  • Utilize safety equipment as needed
  • Disclose any health conditions that may impact their safety
  • Stay within certain areas on the vessel

6.2 Prohibited Items

Boarding with the following items is not allowed:

  • Containers made of glass
  • Illicit substances
  • Weapons or firearms
  • Alcohol in excessive amounts (beyond moderate consumption)
  • Pets (without prior consent)

6.3 Conduct

Passenger behavior should be mannerly and respectful. A charter may be terminated prematurely without refund if passenger actions pose a danger or disrupt the experience for others.

7. Liability and Insurance

7.1 Our Liability

Our financial responsibility is confined to the sum paid for your charter. We do not assume liability for:

  • Injuries to persons brought on by their own carelessness
  • The loss or harm of personal belongings
  • Indirect, incidental, or punitive damages
  • Delays occasioned by weather conditions or events beyond our control

7.2 Insurance Coverage

Comprehensive marine insurance is in place for our vessels and operations. It is the responsibility of passengers to secure their personal travel and property insurance.

7.3 Assumption of Risk

Participation in our charter services means you acknowledge the inherent dangers of marine activities and you accept personal accountability for your safety and welfare.

8. Modifications and Itinerary Changes

Itineraries, course paths, and schedules are subject to alterations based on climatic factors, considerations for safety, or operational imperatives. We will diligently attempt to provide equivalent alternative experiences where possible.

9. Force Majeure

Delays, cancellations, or changes that result from factors outside of our control, which may include, but are not limited to:

  • Severe meteorological conditions
  • Natural calamities
  • Regulatory edicts by governing bodies
  • Shuttering of ports
  • Mechanical breakdowns

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. Engaging with our services implies your consent to the gathering and use of your information as outlined in the said policy.

11. Intellectual Property

The content on our website, including texts, visuals, logos, and imagery, falls under copyright and trademark protection laws. Unauthorized reproduction, dissemination, or creation of derivative works is forbidden without express written permission.

12. Governing Law

These Terms are subject to the jurisdiction of the laws in Montenegro. All disputes will be settled in the courts located in Tivat, Montenegro.

13. Changes to Terms

Modifications to these Terms may be made at any time. Any changes will be communicated on our website, accompanied by an updated date of revision. Continuation of service usage after such alterations constitutes agreement to the amended Terms.
